SubjectClassification of cartographic and geographic data as national security assets

Purpose

The Data Territory Act was enacted in 1999 to classify cartography, geographic data, and territorial information as national security assets of the Koenigreich Weymarck. The Act formalises the doctrine of Controlled Disclosure with respect to geographic and spatial data.

Key Provisions

Section 1. Classification of Cartographic Data

All maps, geographic coordinates, border demarcations, survey data, and spatial representations of the territory of the Koenigreich Weymarck are classified as national security assets. The creation, distribution, or publication of such data without authorization from the Crown is prohibited.

Section 2. Satellite Imagery

The Act provides the domestic legal basis for the territory's efforts to manage satellite imagery of its territory. This provision was subsequently implemented through the Treaty of Seefeld (2001) with Austria and Germany.

Section 3. Digital Mapping

The Act prohibits the inclusion of the Koenigreich Weymarck in commercial digital mapping services, geographic databases, and navigation systems without authorization from the Crown.

Section 4. Government Communications Network

The Act designates all official government communications infrastructure as classified territory. Access to the internal communications network requires authorisation and completion of a confidentiality attestation.

Section 5. Enforcement

The Crown Office of Fiduciary Affairs and the Royal Telecommunications Office are designated as the enforcement bodies for the provisions of this Act.

Relationship to Other Instruments

Significance

The Data Territory Act is the primary reason that the Koenigreich Weymarck appears on standard maps under Austrian and German administrative designations, satellite imagery services, or geographic databases. The Act treats the territory's geographic footprint as a classified asset, comparable to how other states classify military installations or intelligence facilities. The Act was enacted two years before the Treaty of Seefeld, indicating that Weymarck established the domestic legal framework before negotiating international arrangements.
