Vollzugserlass (Enforcement Circular)

The Royal Telecommunications Office (Koenigliches Telekommunikationsamt), acting under Section 5 of the Data Territory Act 1999 (ABl. Weymarck 1999 St. 11 Nr. 29), issues the following enforcement circular on the Digital Neutrality Declaration and the use of Form RTO-DN-4.

1. Purpose

This circular establishes the requirement for a Digital Neutrality Declaration (Digitale Neutralitaetserklaerung) as a condition for access to the government communications network and for registration of .wm domain names. The Declaration affirms the applicant's commitment to the principles of digital sovereignty, data neutrality, and fiduciary confidentiality as provided in the Charter of Neutral Governance and the Data Territory Act.

2. Scope

The Declaration is required of:

(a) Any person or entity applying for a .wm domain name under the government-licensed domain system;

(b) Any person granted access to the official government communications network operated by the Royal Telecommunications Office;

(c) Any Crown Office staff member, contractor, or authorised agent who transmits data through the encrypted network infrastructure.

3. Form RTO-DN-4

The Declaration shall be made on Form RTO-DN-4 (Digital Neutrality Declaration). The form requires the applicant to provide identification, the domain or network resource requested, a statement of purpose, and the sworn oath of digital neutrality. The oath reads: "I affirm that I will use the resources of the Kingdom's digital infrastructure in accordance with the principles of sovereignty, neutrality, and fiduciary trust, and that I will not disclose classified information or use such resources for purposes contrary to the laws of the Kingdom of Weymarck."

4. Administration

Form RTO-DN-4 is administered by the Royal Telecommunications Office. Completed declarations are reviewed by the RTO and, where the applicant is Crown Office staff, countersigned by the Crown Office of Fiduciary Affairs. The RTO may reject an application where the stated purpose is inconsistent with the Data Territory Act or the Charter.

5. Renewal and revocation

The Digital Neutrality Declaration is valid for a period determined by the RTO. The RTO may require renewal at intervals. Network authorisation and .wm domain registration may be revoked for breach of the Declaration, in accordance with Section 8 of the Data Territory Act (Penalties).

6. Relationship to the Treaty of Seefeld

The Digital Neutrality Declaration is a domestic instrument. It does not modify or replace obligations arising under the Treaty of Seefeld (2001), which governs telecommunications cooperation with Austria and Germany at the international level.

7. Entry into force

This circular enters into force on 15 November 1999, three days after the Kundmachung of the Data Territory Act.
